The ruling responded to a protection claim filed by Lotería de Concepción against six leading internet service providers: Claro, Entel, GTD, Telefónica, WOM, and VTR. Lotería argued that illegal gambling websites undermined its exclusive rights and violated national regulations.

In May 2025, the Court of Appeals of Santiago rejected the petition, siding with the internet providers. The Third Chamber of the Supreme Court overruled that decision, siding with Lotería and granting the petition to block online gambling sites.

The Supreme Court confirmed that games of luck are illegal in Chile unless licensed. Only Lotería de Concepción, Polla Chilena, authorized racetracks, and licensed casinos may legally operate gambling.

The justices clarified that in the iGaming sector, only Lotería, Polla, and Teletrak may provide specific games. All other sites are illegal, so internet providers must block access.

The court also addressed net neutrality. Providers may not block lawful content but must block unlawful content. The court held that failing to comply infringes on Lotería de Concepción’s exclusive property rights.

Justice Mireya López and Attorney Carlos Urquieta dissented, affirming the lower court’s denial. They raised concerns about excessive regulation, internet freedom, and providers’ obligations to restrict gambling.

Despite the dissent, the majority decision strengthens protections for state-authorized operators and curbs unauthorized digital platforms.
