Brazilian Court Revokes Spribe AVIATOR Trademark Injunction

A Brazilian court has revoked a preliminary injunction previously granted to Spribe in an ongoing dispute over the AVIATOR trademark. This follows a separate federal ruling that suspended the legal effects of the company’s trademark registration in Brazil.

The Pernambuco Court of Justice ruled that the legal basis for the injunction no longer exists. This follows the Federal Court in Brasília provisionally suspending Spribe’s trademark registration while invalidation proceedings continue.

Court Suspends Exclusivity Claims

The Federal Court also ordered Spribe to refrain from claiming exclusive rights to the AVIATOR trademark until the trademark dispute is resolved.

Judge Andrea Epaminondas Tenorio de Brito noted that the earlier injunction had relied on the assumption that Spribe’s trademark registration with Brazil’s intellectual property authority was fully valid. However, with that registration now suspended, the court determined the injunction should be revoked under Brazil’s Code of Civil Procedure.

Investigation Adds Pressure

The legal dispute comes as Brazilian authorities continue investigating Spribe over alleged misleading advertising and unfair commercial practices.

In June, the Public Prosecutor’s Office of the Federal District and Territories opened an inquiry into claims involving the advertised return-to-player (RTP) of the company’s games. It recommended suspending Spribe’s game certifications and removing its titles from licensed operators pending further review.

Aviator Studio Brasil filed the lawsuit and argues it created and used the AVIATOR trademark years before Spribe obtained protection in Brazil. The court also considered earlier rulings in Georgia that invalidated Spribe’s registration and recognized the rights of the original trademark owner.
