Aviator Wins: Supreme Court of Georgia Rejects Spribe Appeal

The Supreme Court of Georgia dismissed Spribe’s appeal in a long-running intellectual property dispute over Aviator, upholding a previous ruling that invalidated Spribe’s Aviator-related trademarks for the popular crash-style online casino game.

Issued on May 20, the decision confirmed that Spribe registered the trademarks in bad faith and infringed on copyright protections of the original IP owner based in Georgia.

The case centers on the rights to the well-known name and associated airplane imagery that have become key elements of the game.

The IP owner previously secured a $330 million damages ruling against Spribe and Flutter-owned operator Adjarabet in August 2024.

The Court of First Instance had also invalidated the contested trademarks and ordered Adjarabet to stop using the branding on its platform. However, the two parties reached a settlement earlier this year.

Importantly, the Supreme Court’s dismissal finalizes the dispute within Georgia, the jurisdiction of origin for the brand.

A spokesperson for the IP owner noted that this ruling could impact ongoing proceedings at the European Union Intellectual Property Office (EUIPO), where efforts continue to invalidate Spribe’s trademark registrations across Europe.

EUIPO cases remain active, with Spribe reportedly requesting multiple deadline extensions to respond to claims of unauthorized use of the name and imagery on European platforms.

While Spribe continues to contest claims in various markets, the Georgian ruling solidifies the original owner’s status as the legitimate intellectual property holder.

Represented by Georgian law firm Mikadze Gegetchkori Taktakishvili, the company confirmed plans to pursue trademark enforcement vigorously in all jurisdictions where disputes persist.
