Stake Brasil has secured a partial preliminary injunction allowing it to continue operating in Brazil despite Provisional Measure 1,394/2026. The 9th Federal Civil Court of São Paulo granted the injunction, making Stake the first licensed operator to obtain a decision of this kind, according to the company.
Court Preserves Stake’s Authorisation
The injunction temporarily preserves Stake Brasil’s operating authorisation until October 25, 2026. During this period, the stake.bet website and domain cannot be blocked or redirected, and the company cannot face sanctions for operating within the conditions established by the court.
The decision provides temporary legal protection while the broader dispute over the provisional measure remains unresolved.
Stake Highlights Legal Certainty
A Stake Brasil spokesperson welcomed the ruling, saying it provisionally preserves the company’s authorisation to offer fixed-odds betting.
The company argued that operators that have met legal requirements, paid licensing fees and made significant investments should receive due consideration before their authorisations are withdrawn. Stake said the decision reinforces the importance of legal certainty and regulatory stability for businesses operating under state supervision.
Company Reaffirms Regulatory Compliance
Stake Brasil also emphasised the role of regulated markets in protecting consumers. According to the company, clear rules, responsible gaming measures and public oversight are essential to ensuring effective consumer protection.
The spokesperson added that Stake Brasil has continued to comply with the obligations introduced by the provisional measure and will follow both regulatory requirements and judicial orders.
The injunction is preliminary and applies only within the scope and timeframe established by the court. Its longer-term implications for Brazil’s licensed betting market will depend on subsequent legal and regulatory developments.
