Chile Declares Online iGaming Illegal as Comptroller Confirms SCJ Has No Oversight

Chile’s Comptroller General has issued a decisive opinion stating that online gambling is illegal under current law. The ruling, triggered by a citizen complaint, clarifies that the Superintendence of Casinos (SCJ) has no authority to regulate or supervise iGaming platforms operating in Chile. The decision reinforces long-standing judicial interpretations and resets the national debate on online gambling regulation.

SCJ Lacks Authority Over Online Betting

The Comptroller confirmed that the SCJ’s mandate applies only to land-based casinos and activities defined under Chile’s existing casino laws. Since online gambling is not included in these frameworks, the SCJ has no jurisdiction over iGaming operators.

However, the SCJ must still act when it detects illegal gambling. The ruling reiterates the regulator’s responsibility to report unauthorized activity and take legal action when necessary.

iGaming Classified as an Illegal Activity

A core conclusion of the opinion is that online betting is an “illicit activity” unless expressly authorized by law. This aligns with repeated Supreme Court decisions that prohibit online lotteries and sports betting in the absence of a specific regulatory framework. The Court has previously ordered companies to stop promoting such activities and instructed ISPs to block unlicensed gambling websites.

Courts Reinforce Crackdown and Consumer Protection

The Comptroller’s stance mirrors broader judicial efforts to restrict unlicensed gambling. Courts have required telecom providers to block access to certain online betting sites to protect consumers and enforce the law.

The ruling highlights key risks of unregulated platforms:

  • No player-protection safeguards
  • Weak financial integrity
  • No responsible-gaming controls

With no legal framework, consumers are left exposed to fraud, while the state lacks mechanisms to ensure fair and secure gambling practices.

Regulatory Reform Still in Progress

Even as the ruling confirms that online gambling remains illegal today, Chile is actively debating a new regulatory model. A bill introduced in 2022 is now in the Senate, proposing:

  • Licensing requirements
  • Tax and reporting obligations
  • Player-protection standards
  • Market supervision

The government recognizes the growing online gambling market and aims to establish modern rules that balance innovation with consumer safety.

A Pivotal Moment for Chile’s Gambling Future

The Comptroller’s decision is a milestone for Chile’s gambling landscape. By reaffirming the illegality of online gambling and clarifying the SCJ’s lack of authority, the opinion intensifies pressure on lawmakers to advance long-awaited regulation.

While many operators remain active in practice, they operate in a legal gray zone. As the Senate continues debating the proposed bill, Chile faces a critical crossroads: balancing market growth with legal certainty and consumer protection.
