Brasilcon Seeks Role in Supreme Court Case Challenging Brazil’s Bets Law

The Brazilian Institute of Consumer Policy and Law (Brasilcon) has formally requested to intervene in a major legal challenge before Brazil’s Supreme Federal Court (STF). The case concerns the constitutionality of Law No. 14,790/2023, known as the “Bets Law.” This law governs fixed-odds sports betting in the country.

Motion Filed to Join ADI 7,721/DF

On March 10, attorneys Simone Maria Silva Magalhães and Claudia Lima Marques submitted the motion under Article 138 of Brazil’s Code of Civil Procedure. The case, ADI No. 7,721/DF, was originally filed by the National Confederation of Commerce of Goods, Services, and Tourism (CNC). The purpose is to assess whether the current regulation of sports betting aligns with Brazil’s constitution. Justice Luiz Fux, overseeing the case, has emphasized its urgency and complexity.

Consumer Protection and Social Implications

Brasilcon’s motion stresses the “technical complexity” and “social implications” of the case. It notes the broad constitutional and consumer protection issues involved. If granted permission, the institute plans to submit written briefs, memorials, and oral arguments.

The Supreme Court has highlighted eight thematic areas in the hearings:
