Indian Gaming Association Urges Congressional Action on Prediction Markets

The Indian Gaming Association (IGA) has called for urgent Congressional intervention to address illegal sports betting conducted through prediction markets. According to the IGA, these markets violate tribal, federal, and state laws, including the Indian Gaming Regulatory Act (IGRA).

Tribal Gaming Rights at Risk

Chairman David Z. Bean stated that sports betting via prediction markets undermines tribal authority: “Sports betting that is being conducted through prediction markets violates tribal, federal, and state laws – including the IGRA, which expressly provides tribal governments with exclusive authority to regulate gaming on Indian lands in partnership with states and the NIGC.”

Bean emphasized that prediction market platforms are operating outside tribal oversight and are effectively bypassing established protections for tribal gaming.

Regulatory Gaps and the CFTC

Bean criticized the Commodity Futures Trading Commission (CFTC) for failing to determine whether these contracts constitute prohibited gambling activities. He argued that prediction market corporations have deliberately chosen a smaller financial regulator to self-certify and self-regulate their platforms, avoiding scrutiny from more robust regulatory bodies.

Call for Legislative Action

Highlighting the ongoing risks to tribal revenue and gaming integrity, Bean urged Congress to amend the Commodity Exchange Act (CEA) to explicitly prohibit illegal gaming through prediction markets. “Tribes have fought for too long and worked too hard to build and preserve the integrity of our industry and the resources that enable tribal governments to provide for their communities,” he said.

The IGA’s call underscores the tension between emerging online betting platforms and traditional tribal gaming authorities, signaling potential legislative and regulatory changes in the U.S. sports betting landscape.
